Terms of Service & User Agreement

Welcome to PanelPulse (the "App"). This Terms of Service and User Agreement ("Agreement") is a legal contract between you ("User" or "you") and **PanelPulse** ("we," "our," or "us"), governing your use of our mobile application available on the Apple App Store and any associated services (collectively, the "Service").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

1. Acknowledgement

This Agreement is concluded solely between you and PanelPulse, and not with Apple Inc. PanelPulse, not Apple, is solely responsible for the App and the content thereof.

2. Scope of License

We grant you a non-exclusive, non-transferable, revocable license to use the PanelPulse App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Eligibility & User Accounts

Age: You must be at least 18 years old (or the minimum legal age in your country) to use this App. Account Security: If you create an account, you are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

4. Subscriptions and Billing (VIP Membership)

PanelPulse offers premium access, exclusive chapters, and advanced features through auto-renewable subscription plans ("VIP Pass"):

Weekly VIP Pass: $29.99 per week
Monthly VIP Pass: $39.99 per month
Annual VIP Pass: $99.99 per year

Billing Terms:

In-App Purchases: All payments are processed and managed securely through Apple’s In-App Purchase system. Payment will be charged to your Apple ID Account at the confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew at the same price and duration period as the original plan unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
Account Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
Subscription Management: You can modify or cancel your subscription at any time by going to your Apple ID Account Settings on your iOS device after purchase.
Refunds: All refunds are handled exclusively by Apple Inc. according to Apple App Store policies.
PanelPulse cannot directly issue refunds for In-App Purchases.

5. Code of Conduct & Prohibited Uses

You agree not to use the App for any unlawful purpose or in any way that violates this Agreement. Prohibited activities include, but are not limited to:

Using any automated scripts, bots, spiders, or scrapers to access, copy, or monitor content from the App.
Attempting to circumvent, disable, or interfere with security-related features of the App or subscription validation logic.
Engaging in any activity that disrupts or interferes with the performance of our servers or networks.
Posting or distributing abusive, defamatory, obscene, or fraudulent comments within the community sections.

We reserve the right to suspend or terminate your account instantly, without notice or liability, if we determine you have violated these rules.

6. Intellectual Property Rights

All content, features, functionality, software, graphics, user interfaces, and layout designs within the App are the exclusive property of PanelPulse and its licensors. You may not copy, modify, distribute, or create derivative works based on our content without explicit written permission.

7. No Warranty (Disclaimer)

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PANELPULSE DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES, NOR DO WE GUARANTEE THE ABSOLUTE ACCURACY OF ANY CONTENT PROVIDED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PANELPULSE, ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR ACCESS TO OR INABILITY TO USE THE APP.

9. Product Claims & Legal Compliance

Product Claims: PanelPulse, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

11. Third Party Beneficiary

PanelPulse and you acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

12. Changes to the Agreement

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of this document. Continued use of the App after modifications implies full acceptance of the revised Terms.
